Personal Injury Attorney

When life takes an unexpected turn, it helps to have someone who knows how to protect your rights. A personal injury lawyer guides you through the process of recovering compensation after an accident so you can focus on healing while they handle the legal work. Personal injury law gives people the chance to rebuild their lives with fairness and financial peace of mind.

Key Summary:

Personal injury law helps you recover the compensation you rightfully deserve after an accident.

A lawyer handles insurance claims, negotiations, and court filings.
You can seek recovery for medical bills, lost wages, and physical and emotional harm.

What Is a Personal Injury Lawyer?

A personal injury lawyer helps people who have suffered bodily injury or serious injuries because of someone else’s negligence recover compensation for medical bills, lost income, and pain and suffering.

In simple terms, they represent you when you’ve been hurt and someone else is legally responsible. Personal injury lawyers work to prove fault, negotiate with insurance companies providing personal injury coverage, and, if needed, take your legal claim to court.

They focus on cases where another party’s actions or failure to uphold their legal duty caused physical injuries or harm to an injured party. This includes accidents such as:

  • Car crashes caused by distracted or drunk drivers

  • Falls due to unsafe property conditions

  • Injuries from defective products or medical mistakes

A good personal injury lawyer does more than file paperwork; they guide you through the legal process and help you understand your rights under your personal injury protection or insurance policy. A personal injury lawyer guides you through every step of your legal claim and works to recover damages for all your losses.

What Does a Personal Injury Lawyer Do?

A personal injury lawyer guides you through every step of your claim and works to recover full compensation for your losses.

Here’s how they help:

Investigate your case by reviewing police reports, photos, and witness statements.

Calculate your damages, including current and future medical costs, lost wages, and non-economic harm like emotional distress.

Negotiate with insurance companies so you don’t have to deal with adjusters or pressure tactics.

File a lawsuit if a fair settlement can’t be reached.

Represent you in court and present your story to a jury.

In short, a personal injury attorney takes on the legal stress so you can focus on healing. They make sure your voice is heard and your case is valued fairly.

What Types of Cases Do Personal Injury Lawyers Handle?

Personal injury lawyers handle a wide range of cases involving accidents, negligence, and wrongful conduct. Some of the most common include:

Car accidents

Collisions caused by speeding, distracted driving, or failure to follow traffic laws.

Truck accidents

Commercial vehicle crashes that result in severe injuries or wrongful death.

Motorcycle accidents

Often caused by drivers who fail to see or yield to motorcyclists.

Slip and fall injuries

Accidents on unsafe or poorly maintained property.

Medical malpractice

Errors made by doctors, nurses, or hospitals that cause harm.

Defective products

Injuries from faulty designs or manufacturing flaws.

Workplace accidents

Cases involving unsafe working conditions or negligence by employers.

Police excessive force

When law enforcement uses unreasonable or violent tactics that cause injury or trauma. Victims may file both civil rights and personal injury claims to recover maximum compensation.

Wrongful death

When negligence leads to the loss of a loved one.

How Does a Personal Injury Lawsuit Work?

A personal injury lawsuit follows a series of steps designed to prove fault and secure fair compensation.

Here’s the process, step by step:

Consultation

You meet with a lawyer to review what happened and decide if you have a case.

Investigation

Your attorney gathers evidence, including reports, photos, medical records, and witness accounts.

Filing the claim

The lawyer sends a demand letter to the at-fault party’s insurance company.

Negotiation

Both sides discuss settlement options to avoid trial if possible.

Filing a lawsuit

If no fair offer is made, the attorney files your case in court.

Discovery phase

Each side exchanges information, takes depositions, and reviews evidence.

Mediation or trial

The case is settled through mediation or presented before a judge and jury.

Resolution

If successful, you receive compensation for your losses.

Throughout each step, your lawyer keeps you informed and handles the paperwork, deadlines, and communications.

How Long Does a Personal Injury Lawsuit Take?

Most personal injury lawsuits take anywhere from a few months to two years to resolve, depending on the complexity of the case and how quickly both sides cooperate.
Simple cases may settle within months through insurance negotiations, while cases involving severe injuries, multiple parties, or disputed fault can take longer. Factors such as medical treatment timelines, expert reviews, and court scheduling can also affect the process.

While it may take time, a thorough case ensures all damages are accurately calculated and supported by evidence, helping you achieve the best possible outcome.

The Four Elements of Negligence in Personal Injury Law

Personal injury claims are built on the concept of negligence, which means proving that another person failed to act with reasonable care and caused your injury. To win compensation, four key elements must be shown:

  • Duty of care: The defendant had a responsibility to act safely or reasonably.
  • Breach of duty: That duty was violated through careless or reckless behavior.
  • Causation: The breach directly caused your injury.
  • Damages: You suffered measurable losses as a result.

In Colorado, most personal injury cases must be filed within two years of the accident. For motor vehicle accidents, that deadline can extend to three years under C.R.S. 13-80-102.

Proving negligence takes time and careful documentation. That’s why it’s important to act quickly after an accident, while evidence and witness memories are still fresh.

What Damages Can You Recover in a Personal Injury Case?

You can recover both economic and non-economic damages in a personal injury case, covering everything from hospital bills to emotional distress. These damages are meant to help you return, as much as possible, to the position you were in before the accident.

Common recoverable damages include:

Medical expenses:

Hospital stays, surgeries, medications, and ongoing therapy.

Lost wages:

Income lost during your recovery and future earning potential.

Property damage:

Repairs or replacement of your vehicle or personal items.

Pain and suffering:

Physical discomfort and emotional hardship caused by your injury.

Emotional distress:

Anxiety, depression, or loss of enjoyment of life following the accident.

Your personal injury attorney will calculate both the immediate and long-term impact of these losses to pursue fair compensation and help you recover damages through the proper legal process.

How Much Compensation Can You Receive?

The compensation you receive in a personal injury case depends on your injuries, how your life has been affected, and the evidence supporting your claim. Each case is different, but the goal is always to help the injured party recover fully, recover damages, and move forward with confidence.

At Fiedler Trial Lawyers, we’ve recovered millions of dollars for people injured in accidents, medical malpractice, and insurance bad faith cases. Here are a few examples of our results:

  • $4,600,000 settlement offer for a professional athlete after a botched spine surgery.
  • $2,464,571 verdict for a pedestrian hit by a commercial vehicle with a brain injury.
  • $2,000,000 verdict in a medical malpractice wrongful death case.
  • $1,575,000 settlement for serious orthopedic injuries from an equipment loading accident.
  • $988,000 settlement for a couple injured in a head-on collision.

And many more successful recoveries for our clients.
Every case is handled by an experienced trial lawyer who takes the time to understand your story and fight for what you deserve. You never pay any fees unless we recover for you.

Why Is Having a Personal Injury Attorney Important?

Having an experienced attorney can make a major difference in the outcome of your case. Many people try to handle insurance negotiations on their own, only to discover later that they accepted far less than their claim was worth.

An attorney and their legal team help by:

  • Gathering and preserving crucial evidence.

  • Communicating with insurance adjusters on your behalf.

  • Negotiating for a fair settlement that includes all damages.

  • Preparing your case for trial if necessary.

According to a Martindale-Nolo research study, people with legal representation receive significantly higher settlements on average than those who go without.
The study also found that negotiated settlements were about $30,000 higher than initial offers from insurance companies.

That’s because insurance carriers are trained to minimize payouts. A skilled lawyer knows insurance tactics, understands personal injury coverage, and develops potential legal strategies to counter them effectively.

When you work with Fiedler Trial Lawyers, you get a dedicated legal team that treats your case personally and gives you access to trusted legal resources every step of the way. We investigate thoroughly, communicate clearly, and fight for the outcome you deserve.

With over 25 years of trial experience and millions recovered for clients, we never stop working to protect your rights and your time.

What Makes a Good Personal Injury Lawyer?

A good personal injury lawyer combines skill, compassion, and experience to protect your rights and secure fair compensation. They don’t just know the law, they know how to fight for real people.

Look for a lawyer who:

Has a proven record of success in settlements and trials

Communicates clearly and keeps you informed

Understands how insurance companies operate

Has access to expert witnesses and investigators

Treats every client with respect, no matter the case size

Works on a contingency fee basis; you don’t pay unless you win

The right attorney helps you feel supported, confident, and informed every step of the way, because a strong attorney-client relationship is built on trust, communication, and genuine care for your recovery.

The cost of hiring a personal injury lawyer can vary depending on the lawyer and the specifics of your case. However, personal injury lawyers work on a contingency fee basis, which means they only get paid if they win your case. Here’s how the contingency fee structure typically works and other potential costs to consider:

Contingency Fees: Percentage of Recovery: If the lawyer works on a contingency fee basis, they will take a percentage of the settlement or judgment amount you receive if you win your case. This percentage is typically around 33% to 40% but can vary depending on the lawyer and the jurisdiction.

No Win, No Fee: If you do not win your case, the lawyer will not charge you for legal fees. However, there may still be other costs you could be responsible for (discussed below). READ MORE…

In a personal injury claim, you may be entitled to several types of compensation, also known as damages, to address the losses and injuries you’ve suffered due to someone else’s negligence or wrongdoing. The types of compensation typically fall into three main categories: economic, non-economic, and, in some cases, punitive damages. Here’s an overview of each:

Economic Damages: These damages are intended to compensate you for actual financial losses resulting from the injury:

Medical Expenses: Compensation for past, current, and future medical costs, including hospital bills, surgeries, medications, rehabilitation, and any other necessary medical treatment. READ MORE…

The value of a personal injury case can vary greatly depending on several factors unique to your situation. Since each case is different, there is no standard formula to calculate the exact value. However, here are some key factors that generally affect the worth of a personal injury case:

Severity of Injuries: The more serious and long-lasting your injuries, the higher the potential value of your case. This includes considering whether your injuries result in permanent disability or disfigurement.

Medical Expenses: Your case will take into account all medical expenses you have incurred, as well as future medical costs related to your injury.

Lost Wages and Earning Capacity: The case can include compensation for lost income due to time off work and any future loss of earning capacity if your injuries affect your ability to work.

Car accidents are not fun. However, Ken and his team took great care of our family EVERY STEP of the way. From chiropractic car, probate court, insurance negotiations with multiple companies, advice for our family, and collaboration on action items, Ken & team were awesome. I will be sending family and friends to Ken in the future. Thank you for taking great care of my family!

If I could give 10 stars I would! Ken and his team were there for me during the worst time of my life, every step of the way. I had 3 different friends recommend Ken after my car accident and I’m so grateful they did! He always explained everything clearly, walked me through every step, and gave me clear expectations. I was nervous, never having entered into the legal world before, but he made sure I felt safe and supported through the entire process, sending me flowers before surgery, checking in and giving me updates frequently. I never wish anyone to be in a situation like I was but if you find yourself in need of representation Ken and his team are the ones you want! Thank you to Ginger, James and Jahieda as well for always being there for me!

I suffered a spine injury as the result of a T-bone car crash, the other driver at fault. We got nothing but gutter-ball offers from her insurance company. What you hear on the radio is true – the insurance companies simply will not take your case seriously until you file a suit. This is where I was glad to have Ken and his team on my side. The burden to convince a jury of my losses lies with me the plaintiff, which then requires conducting extensive research, gathering and organizing supporting documents. After Ken submitted all of this material during the pre-trial discovery the insurance company decided to make a reasonable settlement offer.
